ORDINANCE NO. 232

 AN ORDINANCE PERMITTING MUNICIPAL COURT MAGISTRATES
TO DISMISS EQUIPMENT VIOLATION CASES AS SPECIFIED HEREIN.

            WHEREAS, Section 12-14-51 of the Code of Alabama authorizes municipal magistrates to dismiss equipment violations where a municipal ordinance allows and where the law enforcement officer signs the Uniform Traffic Ticket and Complaint (UTTC) verifying that the equipment has been repaired and;

            WHEREAS, the equipment violations listed herein are included in the Magistrates Fine Schedule. 

            THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF GRANT, as follows:

            Section I:  Pursuant to Section 12-14-51 of the Code of Alabama, Grant Municipal Court Magistrates may dismiss without court costs Uniform Traffic Ticket and Complaints (UTTCs) issued for the following equipment violations where a Grant law enforcement officer has inspected and verified the equipment has been repaired within 72 hours, excluding Sundays and legal holidays:

                        Improper Lights (Brake Lights; Headlights; Tag Lights; Tail Lights);
                        Improper Muffler; Improper Mirrors (Rearview or Side view);

            Section II:  This Ordinance shall become effective on the 1^st day of  March, 2012.
